General Terms and Conditions (GTC) — S-CLASS CLUB

1. Scope of Application and Service Definition These General Terms and Conditions (GTC) regulate all legal relationships between S CLASS CLUB (Andrei Haldukevich, hereinafter referred to as: S-CLASS CLUB) and its customers. S-CLASS CLUB operates from its base in Munich, Germany, where it acts as a Direct Carrier (Performer) for local transfers and possesses the necessary licenses. For all other European cities (e.g., London, Milan, Paris, Zurich), S-CLASS CLUB acts as the Network Organizer and Broker. S-CLASS CLUB is entitled to engage qualified local partners (subcontractors) to perform transport services. Any deviating terms and conditions are hereby expressly rejected.

2. Conclusion of Contract The contract is concluded only upon the submission of a confirmation email by S-CLASS CLUB.

3. Booking Inquiries S-CLASS CLUB accepts booking inquiries only via its own website. Inquirers must correctly state their full name, the number of passengers, including the need for child S CLASS. CLUB WEBSITE seats, and the number and type (bulky luggage) of luggage items already at the time of inquiry. S-CLASS CLUB reserves the right to reject booking inquiries due to the number of passengers or the size, weight, or type of luggage.

4. Grounds for Termination by S-CLASS CLUB S-CLASS CLUB is entitled to terminate the order, even after confirmation, if the number of passengers and/or the number, size, weight, or type of luggage is significantly greater than agreed or if child seats become necessary for some passengers but the customer failed to communicate this during the booking inquiry.
S-CLASS CLUB is also entitled to terminate the order after confirmation if the passengers and/or their luggage are not completely present at the agreed pick-up location more than 15 minutes after the agreed time. For airport pick-ups, S-CLASS CLUB is entitled to terminate after 60 minutes of fruitless waiting. Flight delays do not change this right of termination.
Furthermore, S-CLASS CLUB is entitled to terminate the order after confirmation if the passengers and/or the luggage pose a danger to the driver, the vehicle, traffic, or third parties. This right of termination applies in particular in the event of contagious diseases, drunkenness, drug consumption, harmful/aggressive behavior, or severe insults of any kind.
In the event of such termination due to circumstances falling within the passenger’s risk sphere, S-CLASS CLUB is entitled to charge up to 100% of the agreed fee as compensation for damages (loss of use). The customer is entitled to prove lesser damage. These terminations can be declared at any time, including immediately before or during the journey.

5. Cancellation by the Customer / Costs The customer can cancel time-based bookings (hourly rentals), long-distance journeys, and day trips free of charge only up to 24 hours before the agreed pick-up time. For airport, city trips/transfers (one-way journeys), the limit is 4 hours before the agreed pick-up time.

If cancellation occurs later, up to 100% of the full agreed fee is payable as compensation for damages (loss of use). The customer is entitled to prove lesser damage.

5.a Exclusion of the Right of Withdrawal A statutory right of withdrawal for consumers does not apply to contracts for the provision of services in connection with leisure activities if the contract provides for a S CLASS. CLUB WEBSITE specific date or period for the performance of the service (§ 312g Par. 2 No. 9 BGB). Since the service is booked for a fixed time, the statutory right of withdrawal is excluded.

6. Customer and Passenger Obligations Customers and passengers are obliged to follow the driver’s instructions during the journey and to refrain from any conduct that impairs the safety of the driver, the vehicle, traffic, or the cleanliness of the vehicle. Customers and passengers are also obliged to truthfully inform the driver about the contents of the luggage.

If a passenger vomits or causes damage in the vehicle, the originator (passenger) must bear the accruing costs for professional vehicle interior cleaning plus loss of use/ compensation for damages. Smoking is strictly prohibited in the car. In case of non compliance, the originator must bear the accruing costs for professional vehicle interior cleaning plus loss of use/compensation for damages.

7. Payment and Pricing The prices indicated in the booking confirmation are final prices (Gesamtpreise) and are binding. These prices include all necessary components of the service and the legally applicable Value Added Tax (VAT/Umsatzsteuer).

Payments must be made exclusively by credit card in Euros. S-CLASS CLUB reserves the right to process (charge) the full price of the booking immediately upon confirmation or at any point prior to the commencement of the scheduled journey.

VAT/Taxation: As the service is organized from Germany, the final price includes the applicable VAT/tax based on the place where the transport service is legally considered to have been performed (e.g., German VAT for local Munich transfers or the corresponding local European VAT rate for services performed abroad). S-CLASS CLUB ensures that the correct tax liability is fulfilled in the respective jurisdiction. The customer is only liable for the final price shown. The due date for payment is upon the processing of the charge by S-CLASS CLUB, as specified above.

8. Routes / Surcharges for Route Deviations, Stopovers, and Customer Delays S-CLASS CLUB will take the fastest route based on the traffic situation. Stopovers and route deviations can be agreed upon after booking confirmation for an additional charge. If S-CLASS CLUB does not exercise the right to terminate due to delay (see Sec. 4), it is entitled to charge a late fee according to the agreed hourly rate for every commenced half hour after the above-mentioned waiting periods expire.

9. Limitation of Liability / Responsibility for Subcontractors S-CLASS CLUB is liable for slight negligence only in the event of a breach of essential contractual obligations, as well as for intent, gross negligence, and damages to life, body, and health. Otherwise, liability is excluded.

Brokerage Liability: Where the transport service is provided by a contracted local partner (subcontractor), the liability of S-CLASS CLUB for the execution of the transport S CLASS. CLUB WEBSITE itself is limited to the careful selection, instruction, and proper licensing verification of that partner. The liability of the performing subcontractor remains unaffected. S-CLASS CLUB is not liable for delays due to the traffic situation.

10. Applicable Law / Place of Jurisdiction The law of the Federal Republic of Germany shall apply. The contract language is German. For contracts with merchants (Kaufleute), the courts at the seat of S-CLASS CLUB (Gräfelfing) have local jurisdiction.

1. Cancellation is possible no later than 24 hours before the scheduled rental time without penalty.

2. If you cancel less than 24 hours before the start of the rental, a penalty of 50% of the cost of the service will be charged.

3. In case of cancellation on the day of rental or non-fulfillment of the order without prior notice — a penalty in the amount of the full cost of the service.

4. All refunds are made within 5 banking days after cancellation, except in cases stipulated separately.
